Encompass Aviation sues Surf Air for $3.1M
Encompass Aviation has filed a lawsuit against Surf Air claiming $3.1 million in “delinquent” payments for flights already flown for the California-based all-you-can-fly service.
The lawsuit states that Surf Air is “financially distressed”, and that Surf Air was unable to “pay [for flights] in advance as required”.
This follows the last week’s news that Surf Air changed the operator for its California flights from Encompass Aviation to Advanced Air. The lawsuit, filed in the US District Court, Southern District of New York, also alleges that Surf Air’s engagement of another carrier violated Encompass’s rights of “first refusal and last offer”.
